These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Copywriters Libres ("we," "our," or "us"), a copywriting studio located at 865 E Noleman St, Centralia, IL 62801, USA. By placing an order through copywriterslibres.com, engaging our services, or otherwise accessing our website, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety.
If you are entering into these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. If you do not agree with any part of these Terms, do not use our website or services.
Copywriters Libres provides professional digital copywriting services, including but not limited to: landing page copy, long-form sales page copy, ad copy packages (Facebook, Google, LinkedIn, and other platforms), crowdfunding campaign copy (Kickstarter, Indiegogo, and similar platforms), press release writing, and case study writing. All services described on our website are delivered digitally. No physical goods are produced, printed, mailed, or shipped in connection with any service.
The specific deliverables for each engagement are determined by: (a) the service or package purchased; (b) the confirmed strategy brief; and (c) any written agreements made during the intake and briefing process. In the event of any conflict between these Terms and the confirmed strategy brief, the strategy brief governs with respect to project scope and deliverables for that specific engagement.
We reserve the right to decline projects that conflict with our values or expertise, that involve content we consider illegal, defamatory, deceptive to consumers, or otherwise harmful. In such cases, we will notify you promptly and provide a full refund if payment has already been received.
Orders are placed through our website at copywriterslibres.com. Payment is collected at the time of order via Stripe, Inc., our third-party payment processor. By placing an order, you authorize the charge of the amount displayed at checkout to your chosen payment method. All prices are displayed and charged in US dollars (USD) unless otherwise explicitly stated.
Prices listed on our website represent the base starting price for each service or the fixed price for each package. The final price for your engagement is confirmed in writing before any work begins. No additional charges are applied beyond the confirmed scope without your prior written consent.
Payment in full is required before the intake process begins. We do not offer payment plans or deferred payment arrangements unless explicitly agreed in writing as part of a separate custom arrangement.
If a payment is declined or reversed without our agreement, we reserve the right to pause or suspend work on any active project until the payment issue is resolved.
Writing does not begin on any project until the following two conditions are both met: (a) you have completed and submitted the intake questionnaire sent after payment; and (b) a strategy brief summarizing the project scope, target audience, deliverables, and key decisions has been confirmed in writing by both you and us.
The delivery timeline for any project begins from the date the strategy brief is mutually confirmed in writing, not from the payment date. Payment initiates the intake process. The delivery clock starts from confirmed brief. This sequence is non-negotiable because the quality of our output depends entirely on the strategy established in the brief.
You are responsible for completing the intake questionnaire accurately and thoroughly. Inaccurate or incomplete intake information that causes material misalignment in the first draft is not grounds for a refund but may result in revision scope adjustments.
If you fail to return a completed intake questionnaire within 60 days of payment, we reserve the right to treat the engagement as abandoned per the terms of our Refund Policy.
Each package includes a specified number of revision rounds as described at the time of purchase and in the strategy brief. The number of included revision rounds for each package is as follows: Spark (2 rounds), Ignite (3 rounds), Blaze (unlimited within 90 days of first draft delivery). Individual service purchases include the revision rounds specified on the relevant service page.
A "revision round" means a single, consolidated set of written feedback from you that we address in one complete pass through the copy. Revision rounds are not individual comment threads, not real-time editing sessions, and not sequential requests submitted separately. All feedback for a single revision round must be submitted together as one document or organized set of comments.
Revisions must address items within the scope of the confirmed strategy brief. Feedback that falls within the confirmed brief is addressed within your included revision rounds. Feedback that requests changes outside the confirmed brief -- such as a different audience, a different offer, a different structure, or a fundamentally different direction -- constitutes a scope change and will be scoped as additional work billed separately.
Revision rounds expire 90 days after the first draft delivery date for all packages except Blaze, which explicitly includes unlimited revisions within 90 days. After expiration, additional revision work is available at our standard hourly rate.
Upon receipt of full payment and delivery of the final files, you receive a non-exclusive, royalty-free, worldwide, perpetual license to use the copy we produce for you for any lawful commercial purpose directly related to your business as described in the intake and brief process. You may publish, edit, modify, adapt, translate, and incorporate the copy into other works as you see fit after final delivery.
"Final delivery" means the delivery of copy after all included revision rounds have been used or you have indicated in writing that the copy is approved. Work that has not reached this stage remains subject to these Terms and does not transfer on delivery of a first or intermediate draft.
You represent and warrant that any brand materials, existing copy, data, testimonials, trademarks, claims, or other materials you provide for us to reference or incorporate are accurate, not misleading, and within your rights to use and share. We are not responsible for verifying the accuracy of materials you provide.
We retain the right to describe the existence and general nature of our work together -- including industry, project type, and outcome metrics where publicly available -- in our portfolio, case studies, and marketing materials. We will not disclose confidential business information, strategy details, unpublished campaign materials, or any materials you designate as confidential. If you prefer your project not be mentioned in any form, request this in writing at the time of the brief and we will honor it.
Your engagement runs on a shared timeline. We commit to our delivery schedule from the date of confirmed brief. In return, you agree to the following client responsibilities:
Delays caused by your failure to meet these responsibilities may extend the delivery timeline proportionally. We are not liable for late delivery caused by client-side delays.
Rush delivery (72-hour first draft for Spark-scope projects) is available as a paid add-on. Rush delivery requires: (a) you return a fully completed intake questionnaire within 24 hours of receiving it; and (b) you confirm the strategy brief on the same business day it is sent to you. Rush add-on fees are non-refundable once the brief is confirmed, regardless of whether the rush timeline is triggered by a delay on your side.
We treat all information shared during the intake, briefing, and engagement process as confidential. This includes your business strategy, unpublished campaign plans, pricing structures, target markets, competitive intelligence, and any materials you designate as confidential. We do not share this information with any third party, use it for any purpose outside your engagement, or reference it in any public communication.
If you require a formal Non-Disclosure Agreement (NDA) to be signed before sharing sensitive materials, contact us before your intake session is scheduled. We can accommodate this with reasonable notice.
Confidentiality obligations survive the conclusion of the engagement.
Copywriters Libres provides professional copywriting services based on established direct-response principles, audience research, and strategic briefing. However, we make no guarantee of specific performance outcomes, including but not limited to conversion rates, revenue increases, funding amounts reached, media placements, cost-per-click reductions, or any other measurable metric.
Copy performance in the real world depends on factors outside our control, including but not limited to: your offer quality and pricing, your target audience definition and traffic source, your page design and technical implementation, your product-market fit, market conditions, seasonal factors, and how the copy is deployed and A/B tested.
We represent that all copy delivered will be: original work not generated by AI writing tools; written to the confirmed strategy brief; produced by a qualified human writer with experience in the relevant format; and delivered in the agreed format on the agreed timeline (subject to client cooperation and any force majeure events).
Our services are provided "as is" to the extent permitted by applicable law. We disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, the total aggregate liability of Copywriters Libres for any claims arising out of or relating to these Terms or our services -- whether in contract, tort (including negligence), or otherwise -- shall not exceed the total amount paid by you for the specific service or engagement giving rise to the claim during the 12 months preceding the claim.
In no event shall Copywriters Libres be liable for: lost profits; loss of business or revenue; indirect or consequential damages; punitive or special damages; loss of data; damage to reputation; or any damages arising from third-party claims -- even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow certain limitations or exclusions of liability. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
You agree to defend, indemnify, and hold harmless Copywriters Libres and its owner(s), contractors, and representatives from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or relating to: (a) your breach of these Terms; (b) your use of delivered copy in a way that violates applicable law or infringes third-party rights; (c) any false, inaccurate, or misleading materials you provided during the engagement; or (d) any third-party claims arising from content you publish using our deliverables.
Neither party shall be liable for delays or failures in performance resulting from causes genuinely beyond that party's reasonable control, including natural disasters, pandemics, internet infrastructure outages, power failures, government actions, or similar events. In such cases, the affected party will notify the other promptly and the performance timeline will be extended proportionally to the duration of the force majeure event. If a force majeure event persists for more than 30 days, either party may terminate the engagement with a prorated refund for work not yet completed.
These Terms are governed exclusively by the laws of the State of Illinois, United States, without regard to its conflict of law provisions. Any dispute arising under or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Marion County, Illinois.
Before initiating any legal proceedings, both parties agree to attempt to resolve disputes in good faith through direct communication. Either party may initiate this resolution process by sending a written description of the dispute to the other party. The parties agree to allow 30 days for good-faith resolution before pursuing formal legal remedies.
We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. For material changes, we will take reasonable steps to notify active clients. Your continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms. If you do not agree with any changes, discontinue use of our services and contact us to discuss any active engagements.
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unenforceable, or contrary to applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be modified, severed from the Terms. The remaining provisions shall continue in full force and effect.
These Terms, together with the confirmed strategy brief for your specific engagement, any written communication in which specific agreements are made, and our Refund Policy and Delivery Policy, constitute the entire agreement between you and Copywriters Libres with respect to the services. They supersede all prior discussions, representations, negotiations, or proposals, whether written or oral.
